Objetivo: o objetivo deste estudo é analisar se a obrigatoriedade da utilização dos meios alternativos de solução de conflitos (conciliação e mediação) por parte da Administração Pública pode ser considerada um direito fundamental do cidadão, e não apenas uma faculdade do ente público, isso porque, sendo a mediação e a conciliação instrumentos que viabilizam a duração razoável do processo, não podem ser retirados da esfera de decisão do administrado sem seu consentimento. Método: será utilizada como método da pesquisa a revisão bibliográfica de textos nacionais de constitucionalistas e processualistas que tratam dos conceitos dos direitos fundamentais, da garantia fundamental da duração razoável do processo e também dos meios alternativos de solução de conflitos na implementação e ainda dos limites dos poderes da Administração Pública. Resultado: o resultado esperado é que, ao final, conclui-se que a utilização dos meios alternativos de resolução de conflitos (mediação e conciliação) é um direito fundamental do administrado como forma de lhe garantir a efetivação da garantia da duração razoável do processo.
