Description
Résumé:This article brings together elements for a critical analysis of art. 95 of Law No. 14,133/2021 (which determines the drawing up of an administrative contract instrument), in comparison with the current scenario of digital culture and the adoption of digital documents by the Public Administration. Carried out using the hypothetical-deductive method, the research hypothesizes that the legal requirement to formalize an administrative contract instrument is out of step with the emerging digital culture in society and, from a legal perspective, is an obsolete measure to regulate relationships contractual agreements between the State and individuals. As a result, the article presents elements that confirm the proposed hypothesis. Although legally required, the drawing up of a specific contractual instrument appears to be obsolete, as the conditions that define and guide the contract appear in the bidding notice (or in the act that authorizes direct contracting) together with the winning proposal, information that, in digital media, can be managed, without the need for consolidated reproduction.
