Mediation, an appropriate locus for the peaceful resolution of conflicts, is an important democratic instrument and should be encouraged. |

Objetivo: pretende-se, com o presente artigo, apresentar um panorama da mediação, estabelecendo seu escopo, diferenciando suas bases daquelas do processo judicial e examinando sua estrutura e funcionamento, de modo a evidenciar suas peculiaridades e atores. Método: utilizou-se metodologia teórica, bibliográfica e documental, com abordagem dedutiva e procedimento comparativo, tendo como referencial o Manual de Mediação Judicial do Conselho Nacional de Justiça. Nos procedimentos autocompositivos, como a mediação, uma vez que a decisão é construída pelos próprios mediandos, obtém-se ganho de tempo e redução de custos, além de maior controle e segurança jurídica. Resultado: a partir da descrição de um panorama da mediação, conclui-se que se trata de um locus adequado para a solução pacífica dos conflitos, construindo importante instrumento democrático que deve ser estimulado.
