Descripción
Sumario:This paper aims to investigate the contours assumed by the guarantee of access to justice within the framework of the sustainable development of the Federative Republic of Brazil, in order to counter the current factual limitations of this important constitutional guarantee with the ideal of equal access to justice for all, embodied in Sustainable Development Goal 16 of the United Nations 2030 Agenda for Sustainable Development. Elaborated using inductive reasoning, descriptive approach and bibliographic research, the paper starts from the analysis of the cultural construction of the guarantee of access to justice, to then delimit the doctrinal and legal panorama in which the guarantee is inserted and examine the bottlenecks it presents in the contemporary Brazilian legal scenario. In the end, the paper intends to demonstrate that a discourse in favor of equal access to justice for all that is not adherent to the factual reality translates into a real obstacle to the achievement of Sustainable Development Goal 16 - and, therefore, to the sustainable development of the Republic.
