Objetivo: a proposição deste ensaio objetiva analisar como o acordo de leniência funciona na condição de instrumento de efetividade das ações civis públicas por ato de improbidade administrativa, pois, em muitas situações, as condutas que ensejam a celebração dos referidos acordos também figuram como atos de improbidade administrativa previstos na Lei 8.429/1992. Nesse sentido, é necessário verificar quais as consequências advindas da celebração do acordo de leniência pela pessoa jurídica para a efetivação do objetivo de preservar a probidade administrativa prevista na Lei 8.429/1992. Método: a metodologia empregada baseia-se na análise das principais características do acordo de leniência, nos dispositivos da Lei 12.846/2013, que tratam do tema, nos atos tipificados como ímprobos e suas respectivas sanções e, por fim, na conclusão acerca das consequências referentes à efetividade das sanções, em razão da prática de atos de improbidade administrativa por ocasião da celebração de acordo de leniência pela mesma pessoa jurídica. Resultado: ao final deste ensaio, constata-se que o acordo de leniência previsto na Lei 12.846/2013, ainda que esteja inserto em diploma legal específico que trata das sanções em razão da prática de atos de corrupção praticados por pessoas jurídicas, pode ser aplicado no âmbito da ação civil pública por ato de improbidade administrativa, tendo em vista que integra o mesmo microssistema de combate à corrupção.
