Resumo:The objective of this text is to study the possible alteration of the Constitution of the Republic of 1988, which does not admit political citizenship to immigrant non-nationals. Therefore, we want to examine how this scenario is set today, comparing this panorama with the ideas of post-nationality and post-citizenship that can serve as a reference to redesign the molds we currently have established regarding the right to vote and the right to be voted of the immigrant non-national. In this way, it will be necessary for us to look at some classical institutions such as nationality, citizenship, right to vote, right to be voted, sovereignty and new interpretations of these premises in respect of the indivisibility of Human Rights. The methodology used will be the handling of the inductive scientific method, the examination of the Constitution, Laws, authors of human sciences and Comparative Law, above all, Latin American and European, so that we can explain our vision regarding the chance that could be given to non-immigrant nationals to vote and be voted. Our theoretical framework will be Hanna Arendt with her important reverberations on the expression “right to have rights” with regard to the Human Rights of non-immigrant nationals.
