This study makes a brief incursion into American law, in order to apprehend the notion of duty of candor, and also discusses the relationship between precedents and the cooperative process model. In the end, it is concluded that, despite all the ethical guidelines adopted by the Code of Procedure, there is no duty in Brazilian law for the parties to assist the court by exposing unfavorable precedents to their own claims, taking into account the lack of legal provision to punish this conduct. |

Objetivo: este trabalho analisa se o modelo de processo civil cooperativo ou o próprio princípio da cooperação positivado no Código de Processo Civil impõe um dever de candura às partes, como sugerido em recente precedente do Superior Tribunal de Justiça, e a exemplo do direito processual estadunidense. Método: neste estudo se faz breve incursão no direito americano, para apreender a noção do dever de candura, e bem assim se discute a relação entre precedentes e modelo cooperativo de processo. Resultado: ao final, conclui-se que, apesar de toda a pauta ética adotada pelo Código de Processo, não há no direito brasileiro um dever das partes de auxiliar a corte expondo precedentes desfavoráveis às próprias pretensões, tendo em conta inclusive a falta de previsão legal para punir esta conduta.
