| description | This paper aims to analyze the institute of existential damage in the field of civil liability based on the notion of dignity thought by Giovanni Pico Della Mirandola. Despite the extensive temporal distance that separates the philosopher from the new conceptions of damage in Civil Law, this paper sought to establish a dialogue between Pico's freedom and the existential dimension protected by the damage to the life project. To do so, it is based on the epistemological cut of the constitutionalization of Civil Law, in which the privilege of "being" over "having" and the broad contemplation of the person as a presupposition of the legal order, sheltered by the principle - and supreme value - of the dignity of the human being, took place. To reach the final objective, the analytical category of research was existentialism, especially related to the self-determination of the human being. Furthermore, the problem presented refers to the possibility of applying existential damage in the Brazilian legal system, based on the idea of dignity constructed by Pico Della Mirandola. Finally, a qualitative approach was used as methodology, with a basic nature and exploratory objective, through bibliographical research. |

Objetivo: o presente artigo visa analisar o instituto do dano existencial no campo da responsabilidade civil a partir da noção de dignidade pensada por Giovanni Pico Della Mirandola. Apesar da extensa distância temporal que separa o filósofo das novas concepções de dano no direito civil, este trabalho buscou estabelecer o diálogo entre a liberdade em Pico e a dimensão existencial tutelada pelo dano ao projeto de vida. Para tanto, ampara-se no recorte epistemológico da constitucionalização do direito civil, no qual houve o privilégio do ser sobre o ter e a ampla contemplação da pessoa como pressuposto da ordem jurídica, albergados no princípio – e valor supremo – da dignidade da pessoa humana. Para atingir o objetivo final, a categoria analítica de pesquisa foi o existencialismo, sobretudo relacionado à autodeterminação da pessoa humana. Ademais, a problemática apresentada se refere à possibilidade de aplicação do dano existencial no ordenamento brasileiro com amparo na ideia de dignidade construída por Pico Della Mirandola. Resultado: toda essa análise revela como resultado a pertinência do diálogo entre a filosofia de Pico e as modernas noções da responsabilidade civil, sobretudo quando ancorada no existencialismo, com destaque à autodeterminação como essencial na tutela do projeto de vida. Método: por fim, foi utilizada como metodologia a abordagem qualitativa, com natureza básica e objetivo exploratório, mediante pesquisa bibliográfica.
