| Resumo: | This article aims to analyze characteristics, capabilities and limits of the Jury Court, an individual guarantee recognized by the Brazilian Constitution of 1988 that has always faced great challenges and controversies. Based on a special study of the principles of the fullness of defense and the sovereignty of verdicts, the text deals with doubts about the nature and contours of popular deliberation, intending to harmonize jury discipline with the accusatory model that guides the criminal justice system in Brazil. Descriptive, deductive and theoretical-argumentative methods are used based on bibliographic and jurisprudential research and on national regulations related to the theme. The lines study details of this important instrument for the realization of active democracy, which contributes to the legitimacy of the exercise of jurisdiction. Next, discussions regarding objections and appeals inserted in the Code of Criminal Procedure against the decision of the jurors will be mentioned, as well as a systematic interpretation due to possible conflicts of constitutional commandments. Finally, the inequality between prosecution and defense in criminal law is recognized, and, considering the fundamental value of the right to freedom, it is concluded that the flexibility of the sovereignty of the verdicts must always be operated in order to protect the guarantees of the defense, also proving to be inadmissible a condemnatory decision in the jury when the acquittal is requested by the Public Prosecution Office.
