Objetivo: o presente trabalho visa abordar a alteração legislativa brasileira na Lei de Migração, que passou a obrigar a motivação do ato que impede um estrangeiro de ingressar em território brasileiro. A relevância deste assunto decorre, primordialmente, de o fato dessa mudança no ordenamento jurídico pátrio destoar da interpretação internacional, que desobriga a motivação do referido ato, considerando sua natureza eminentemente política ou governamental. Método: para a análise, a pesquisa será dogmática, utilizando-se de referências doutrinárias e jurisprudenciais, buscando compreender como essa norma interfere na soberania dos Estados. Ao final, questiona-se se essa mudança pode ser vista como norma de proteção internacional aos direitos do homem, com o objetivo de resguardar eventuais abusos e discriminações por parte da autoridade estatal. Resultado: conclui-se que a opção do legislador brasileiro em tornar necessária a fundamentação desse ato resulta na relativização da soberania estatal, atributo intrínseco de todo Estado.
