Description
Résumé:The present study aims to assess whether the use of alternative means of resolving conflicts by the Public Administration is a fundamental right of citizens, as it is an instrument to guarantee the reasonable duration of the process and not a state option. To this end, the fundamental guarantee of the reasonable duration of the process and the role of alternative means of conflict resolution in the implementation of said guarantee are analyzed, in general terms, through a bibliographical review, as well as the application of these means in the face of protected rights by the Public Administration. In the end, it is concluded that the use of alternative means of conflict resolution is a fundamental right of the administrator as a way of guaranteeing the effectiveness of the guarantee of the reasonable duration of the process.
