| description | The present work aims to examine the controversial support-related debts of certain credits from the employment relation. To achieve this, legislative, case law, and bibliographical research methodology was used in the fields of Constitutional Law, Administrative Law, Labor Law, Civil Procedure and Labor Procedure. Initially, a study is conducted on the concept of support-related debts. Then, the interpretation of Article 100, Paragraph 1, of the Constitution of the Federative Republic of Brazil, is analyzed, as well as the relationship between the support-related debts and the provision of services in the employment relationship. Thereafter, a comparison is made between the support-related debts and compensatory amounts, with the analysis of practical examples, the Federal Supreme Court and the Superior Court of Justice's cases law, and circumstances that could theoretically remove the support-related debts character of labor funds. In conclusion, it is exposed whether or not there is a modification of labor's credits nature in the cases. |

Objetivo: o presente trabalho pretende examinar a controvérsia sobre a natureza alimentar de determinados créditos trabalhistas para fins de regime de precatório. Método: para tanto, foi utilizada metodologia de pesquisa legislativa, jurisprudencial e bibliográfica nos campos do Direito Constitucional, do Direito Administrativo, do Direito do Trabalho e do Direito Processual Civil. Inicialmente, estuda-se sobre o conceito de créditos de natureza alimentar. Em seguida, analisa-se a forma de interpretação do art. 100, § 1º, da Constituição Federal de 1988, e a relação entre a natureza alimentar e a prestação de serviço na relação de trabalho. Logo depois, realiza-se o cotejo entre as naturezas alimentar e indenizatória, com as análises de exemplos práticos, jurisprudências do Supremo Tribunal Federal e Superior Tribunal de Justiça e circunstâncias que teoricamente poderiam retirar o caráter alimentar das verbas trabalhistas. Conclusão: como conclusão, expõe-se se há ou não modificação dessa natureza.
