Description
Résumé:This article analyzes the position of the Court of Justice of the Federal District and Territories (TJDFT) regarding civil liability for copyright infringement on marketplace platforms. With the growth of e-commerce and the involvement of third parties in product sales, several cases of plagiarism and copyright infringement have emerged. The aim is to identify the alignment of the TJDFT with the Marco Civil da Internet (Law No. 12,965/2014), which regulates internet use in Brazil. The method includes bibliographic reviews and analyses of TJDFT court decisions. The research reveals discrepancies in court rulings, creating legal uncertainty. It concludes that there is a need for jurisprudential harmonization by the higher courts to establish a uniform interpretation of liability on marketplace platforms.
