| Resumo: | With the advent of Law No. 14,994/24, many changes were promoted in the Brazilian legal system in order to prevent and curb violence against women, including in relation to femicide, which was elevated to the status of an autonomous criminal offense, with specific rules, which may have an impact on the jurisprudence of the Superior Court of Justice with regard to the nature of the qualifier. Thus, through the deductive method, the present work aims to clarify whether the understanding adopted by the Superior Court was overcome in the face of the new legal diploma and whether the new provisions on femicide can retroact to benefit the perpetrators of criminal conducts practiced before the entry into force of the legal changes. In the end, what is sought is to identify how the correct interpretation of the law would be and its effectiveness over time. |
