Descripción
Sumario:This article aims to present an overview of mediation, establishing its scope, differentiating its bases from those of the judicial process, and examining its structure and functioning, demonstrating its peculiarities and actors. Theoretical, bibliographical and documentary methodology was used, with a deductive approach and comparative procedure, using the Manual of Judicial Mediation of the National Council of Justice as a reference. In self-compositional procedures, such as mediation, since the decision will be constructed by the mediators themselves, there is a gain in time and cost reduction, in addition to greater control and legal certainty. Mediation, an appropriate locus for the peaceful resolution of conflicts, is an important democratic instrument and should be encouraged.
