Description
Summary:This paper aims analyze the interest to appeal from the perspective of the Incident of Repetitive Claims. To do so, it will be necessary, initially, to indicate the concept and characteristics of the Incident of Repetitive Claims. It is intended to present the views of the doctrine on the referred incident, adopting, form a critical point of view, that its main function is to serve as a procedural technique to preserve the coherence of the legal order. Afterwards, the objective will be to point out the understanding that doctrine has historically built on the appellate interest, indicating its characteristics and controversies about its concept.  With the analysis, we seek to point out to what extent the interest to appeal must be rethought to comply with the purposes of the Incident of Repetitive Claims, indicating the way in which the courts have understood the issue.
