Description
Summary:The present work aims to examine the controversial support-related debts of certain credits from the employment relation. To achieve this, legislative, case law, and bibliographical research methodology was used in the fields of Constitutional Law, Administrative Law, Labor Law, Civil Procedure and Labor Procedure. Initially, a study is conducted on the concept of support-related debts. Then, the interpretation of Article 100, Paragraph 1, of the Constitution of the Federative Republic of Brazil, is analyzed, as well as the relationship between the support-related debts and the provision of services in the employment relationship. Thereafter, a comparison is made between the support-related debts and compensatory amounts, with the analysis of practical examples, the Federal Supreme Court and the Superior Court of Justice's cases law, and circumstances that could theoretically remove the support-related debts character of labor funds. In conclusion, it is exposed whether or not there is a modification of labor's credits nature in the cases.
