| Sumario: | This article analyses the compatibility between the non-prosecution agreement (ANPP), the adversarial system, and the principles that guide the criminal process in Brazil. The Constitution of the Republic adopted the adversarial system with this understanding being pacified by the Brazilian Supreme Federal Court. The non-prosecution agreement, introduced by Federal Law No. 13.964/2019 (Anti-Crime Law) in the Brazilian Criminal Procedure Code, is compatible with the consensual criminal justice perspective. Observing the assumptions and characteristics of the adversarial system and the criminal procedural principles, it is concluded that the ANPP does not violate them. |
