| Résumé: | The nature on which copyright in Brazil is based reveals peculiar characteristics that must be observed considering its moral and patrimonial character. Therefore, its regulation presents specific distinctions between what can and cannot be protected by the Copyright Law. In this context, this article aims to analyze how the technical-scientific production of government agencies can be treated considering the Copyright Law. For that, it is necessary to discuss digital libraries as a locus of technical memory management. It discusses important aspects of the Copyright Law in Brazil, presenting characteristics that involve the protection of the author over the work, moral and patrimonial rights, as well as copyright contracts. The aim is to outline the criteria that allow recognizing, in specific cases, the technical-scientific production generated within the scope of government bodies as an object of copyright protection. As a methodology to be adopted, it is an exploratory and documentary research. Finally, it examines cases in which the production of technical knowledge documents produced within the scope of public authorities is supported by the Copyright Law. It is concluded by the subtle existence of characteristics that can be observed considering the need for consideration in the analysis in a specific case, as well as the documental typology produced in governmental bodies. |
